Purpose

 

The purpose of this procedure is to provide any employee who has a concern pertaining to a salary issue associated with his/her position an opportunity to have that concern addressed in the appropriate forum.  The concern would need to fall under one of three areas: reclassification, retitlement, or salary review as defined below in order to be considered.  A salary related concern shall not be addressed through the grievance policy. 

 

The Compensation Classification Committee (CCC) is the advisory structure through which salary issues as defined below shall be heard.  The CCC is advisory to the Superintendent and/or designee and may recommend actions for consideration resulting from its review of salary issues.  For the purpose of this procedure, the Assistant Superintendent of Human Resources/Staffing and Development (referred to as Assistant Superintendent hereafter) will serve as the Superintendent's designee.  All salary related issues must be submitted to the CCC via the Assistant Superintendent.

 

Written requests or appeals not submitted on the appropriate form with the appropriate documentation or through the correct process will not be considered.

Definitions

 

 

A.

Reclassification: occurs when all employees of a specific job title are moved from one pay range to another. 

 

 

B.

Retitlement: occurs when an employee’s title is changed from one Board approved position to another based on a review of the employee’s duties.  A person will need to demonstrate that s/he is performing the duties of another titled position in order to be considered for retitlement.  Retitlement is not appropriate when an employee is promoted to a vacant position. The school system shall follow the policies for filling a vacant position, including posting the position.  A promoted employee’s salary should be changed at the time of the promotion.

 

 

C.

Salary review: occurs when an employee believes that the salary administration guidelines have been misapplied for his/her position.  A salary review shall not include any reconsideration of an employee's performance evaluation ratings.

Time Limitation

 

 

An employee must comply with the time period specified in this procedure for his/her request to be considered.  Once a withdrawal or a final determination on a request has been made, another request by the same employee may not be filed for one (1) year following the date of the withdrawal or final decision.

Compensation Classification Committee

 

 

The purpose of the CCC is to maintain the integrity of the job classification structure by considering requests for job reclassification, retitlement and salary reviews.

The CCC is made up ten (10) voting members which consists of an administrator from Administrative Services, Auxiliary Services, Evaluation and Research, Human Resources, Instructional Services, Operational Services, and Technology Services as well as one employee each from the Division of Principals, NCAE, and the Support Advisory Committee.  The committee shall be facilitated by the Assistant Superintendent who shall be a non-voting member.  A person designated by the Assistant Superintendent shall serve as the secretary for the CCC and shall be a non-voting member.  A representative of the budget department may serve as an advisory, non-voting member.

 

 

A.

The CCC will meet on a regular basis to review reclassification, retitlement and salary issues and recommendations according to a published calendar.  All information for review by the CCC is to be forwarded by the employee or cabinet member to the Assistant Superintendent no later than ten (10) business days prior to the regularly scheduled meeting.  The Assistant Superintendent may call a special meeting of the CCC if the volume of requests necessitates additional time for review.

Beginning July 1, 2000, voting members of the CCC shall serve terms of two (2) years; provided, however, that in the first year of enactment of this committee, one-half of the members as determined by the committee shall serve only one (1) year.

 

 

 

2.

At the last meeting for the school year 2000-2001, the five (5) new members replacing the members whose terms shall end June 30, 2001, shall attend the meeting as non-voting members.  The same process shall occur each year thereafter to provide a rotating committee membership.

 

 

B. 

No member of the CCC may serve successive terms.

A. 

An employee who believes that s/he has a salary related concern that calls for reclassification, retitlement or a salary review, shall first discuss his/her concern with his/her supervisor.  If, after consulting with the Assistant Superintendent, the supervisor believes that the issue is not related to a simple error in calculation, the employee may complete the Request for Review Form and submit it to his/her principal or the Cabinet member associated with his/her department for review.  Anyone submitting a request shall include the following documentation:

Rationale for the request

 

 

 

c)

Job description and applicable licensing requirements

 

 

 

d)

Completed Job Evaluation Questionnaire

 

 

 

e)

Position history and/or pay history

 

 

B.

Upon receipt of the Request for Review Form, the principal or Cabinet member shall decide whether to support the request.  The principal or Cabinet member shall complete his/her portion of the Request for Review Form indicating the decision and provide his/her reasons for the decision.

 

 

 

1.

If the principal or Cabinet member supports the employee’s request, s/he shall forward the Request for Review Form and accompanying documentation to the Assistant Superintendent no later than ten (10) business days prior to the next regularly scheduled meeting of the CCC in order for the request to be considered at the CCC’s next meeting.

 

 

 

2.

If the principal or Cabinet member is not in support of the request, the principal or Cabinet member shall respond in writing to the employee with an explanation of the decision.  If the employee disagrees with the principal's or Cabinet member's determination, s/he may seek an additional review by submitting the Request for Review Form to the Assistant Superintendent within fifteen (15) business days of the principal's or Cabinet member’s written response.  The employee must attach to the form the principal's or Cabinet member’s determination and all of the documentation listed above.

 

 

C.  

Upon receipt of the Request for Review Form, the Assistant Superintendent shall put the request on the agenda to be reviewed by the CCC.  The Assistant Superintendent shall provide written notification to the supervisor and employee of receipt of the form(s) indicating that the CCC will review the matter.

At any meeting of the CCC, there must be a quorum consisting of 2/3 of the voting members (7) present for a request to be considered.  The committee will recommend approval or disapproval of the employee's request.

 

 

 

2.

The Committee's review process will be guided by consensus.  In cases where consensus cannot be reached, a 2/3 vote will be required to recommend approval of the employee's request.

 

 

 

3.

The recommendation of the CCC will be forwarded to the Superintendent or designee for consideration based on the type of request.  Approval of the Board of Education is required for reclassifications.

 

 

 

4.

The Assistant Superintendent shall send written notice of the action taken on the CCC’s recommendation directly to the employee within ten (10) days following a decision.  Copies shall be sent to the sponsoring Cabinet member or principal, Budget and Compensation Services (as appropriate), and a copy kept in the Assistant Superintendent's office.  The CCC shall be notified of the results at the next scheduled meeting.

 

 

 

 

a.

If the employee does not agree with the decision, the employee may submit a written request for review by the Superintendent or designee within 15 days of notification of the action taken specifying the reasons for requesting the Superintendent’s review.  The Superintendent or designee will review the documentation considered by the CCC and Assistant Superintendent.  No additional information will be considered.

 

 

 

b.

When the Superintendent or designee completes the review, the employee will be notified in writing of the outcome.

 

D.

All employees and administrators are directed to provide information upon request to the CCC or Assistant Superintendent to facilitate the review of salary related issues.  The CCC may table a request until the next meeting in order to obtain additional information as needed.

Guidelines for Implementation

 

 

A.  

The necessary steps of this compensation review procedure will be followed to the convenience of all parties, whenever possible.  When meetings are held during work hours, no employee shall suffer loss of pay for time away from his/her duties, nor shall s/he receive extra pay when meetings are held at a time other than working hours.

 

 

B.  

No reprisals of any kind shall be taken by the Board or any employee of the Wake County Public School System against any party in interest or other employee on account of his/her participation in the compensation review request or due to the decision.

 

 

C. 

The request for a compensation review may be voluntarily withdrawn at any level.  Once a request for a review is withdrawn, it cannot be re-opened.  However, in accordance with §3700.2/4700.2 above, an employee may initiate a new request one year following the date of the withdrawal.

 

 

 

 

 

D.  

All parties shall respect the confidentiality of the compensation review procedure by holding in confidence any confidential facts and information shared in meetings and written documentation.
